“On July 9, 2019, the U.S. Court of Appeals for the 5th Circuit will hear oral argument in Texas v. U.S., the next round of litigation challenging the Affordable Care Act (ACA). The appeals court is reviewing a federal trial court’s decision that the ACA’s minimum essential coverage provision (known as the individual mandate) is unconstitutional and, as a result, requires the entire ACA to be overturned. The individual mandate provides that most people must maintain a minimum level of health insurance coverage; those who do not do so must pay a financial penalty (known as the shared responsibility payment) to the IRS. The individual mandate was upheld as a constitutional exercise of Congress’ taxing power by a five member majority of the U.S. Supreme Court in NFIB v. Sebelius in 2012.

“It’s even clearer now how much the GOP plan to replace the Affordable Care Act will change health insurance for just about everyone.
The nonpartisan Congressional Budget Office Monday released its estimates of the cost and impact of the House Republican plan known as the American Health Care Act. Chief among its findings is that the number of people without health insurance would increase by 14 million in 2018. By 2026, that figure would hit 24 million.

“On Dec. 28, 2015, the IRS announced that it is granting an automatic extension for the 2015 information returns required of insurers, employers and certain other providers of Minimum Essential Coverage (MEC) under Section 6055 and 6056 of the Internal Revenue Code (IRC).
Coverage providers that need more time now have until March 31 to get Form 1095 to individuals and until June 30 to electronically file with the IRS. For providers not filing electronically, the deadline is May 31, 2016. (more…)

Kaiser Health News reports:
“Businesses in five states will get an early look at the federal health insurance marketplace for small businesses, the Centers for Medicare and Medicaid announced Wednesday.
The states are Missouri, Illinois, Ohio, New Jersey and Delaware.
Businesses with fewer than 50 full-time workers in those states will be able to access the Small Business Health Options Program, or SHOP, in late October, ahead of the Nov. 15 start of open enrollment.
The five states were selected based on the agency’s analysis of state insurance markets and the availability of employee choice, among other factors, a department official said.

“The U.S. Department of Health and Human Services (HHS) made the Patient Protection and Affordable Care Act (PPACA) basic preventive services package famous by putting a controversial mandate — for “free” birth control benefits — in the package.
Consumer groups say patients are having trouble using the other, less controversial benefits in the package, such as access to checkups, vaccinations and some cancer screenings.

“More than 10 million people sought help outside of brokerages and agencies during the Affordable Care Acts first open-enrollment period, but benefit adviser help was still considered by many to be most valuable.
SourceMedia’s Partner Insights program enables marketers to deliver relevant content and insights directly to the Employee Benefit News audience via SourceMedia’s digital media platforms. Partner Insights content is produced by the marketer. An estimated 10.6 million people nationally received personal help from navigators and assisters during the ACAs first open enrollment period, according to a new Kaiser Family foundation survey of navigators and assister programs. The survey estimates that the 4,400 assister programs operating nationally had an estimated 28,000 full-time staff and volunteers, suggesting each assister would have helped more than 370 people on average during the six-month open enrollment period that ran from Oct. 1, 2013 through March 31, 2014.

“So far, few small businesses have signed up for group health insurance through the new exchanges created by Obamacare. Here’s why.
The Obama administration has been touting its success at getting 8 million Americans signed up for individual health plans through new health-insurance marketplaces. But so far, it has kept mum about the number of small businesses that have enrolled in group plans via SHOP marketplaces, designed to help companies with 50 or fewer full-time-equivalent employees find affordable coverage. These federally-run exchanges are the default option in 34 states that declined to manage their own insurance marketplaces.

“As employers and insurance companies shift more health costs into workers’ pockets, hospitals are making a discovery. The pockets aren’t bottomless.
“The number of accounts that we’re seeing that relate to these high-deductible plans has been building, and it has been putting pressure on our bad debt levels,” Tenet Healthcare financial chief Daniel Cancelmi told stock analysts last week. “We’ve seen it building over the past several years, and it’s continued into 2013 as well.”
