Health-Care Case Puts Congress On Trial

Insurance News Net reports:

“April 16–The Patient Protection and Affordable Care Act was passed to deal with a modern American problem : 50 million Americans living without health insurance.

Its fate, however, will be decided by one of the oldest concepts of American law: that Congress’ power has limits and that the U.S. Supreme Court gets to decide where to draw the line.

However the court rules on the question of whether Congress overstepped its power in requiring virtually every American to buy health insurance, it could set important limits for future lawmakers.

Employers Responsible for W-2 Reporting

“As part of the Affordable Care Act (ACA), employers are required to report the cost of health benefits coverage under an employer-sponsored group health plan. This applies to both self-funded (ASO) and fully insured employer groups.

Complying with the mandate is the responsibility of the employer. Therefore, employers are encouraged to consult with their tax and legal resources for assistance with meeting the reporting requirements.

Beginning in January, employers that were required to file at least 250 2011 W-2 forms were required to start tracking the total cost of health care coverage for tax year 2012. This information will be reported to the Internal Revenue Service on employee W-2 forms that will be issued in early 2013. This reporting is for informational purposes only and does not affect an employee’s tax liability.

However, for small groups (employers that were required to file fewer than 250 2011 W-2 forms), reporting will continue to be optional for the 2012 tax year.

“Applicable employer-sponsored coverage” generally means coverage under any group health plan made available to the employee by an employer, which is excludable from the employee’s gross income under the Internal Revenue Code. The coverage is typically excludable from the employee’s gross income under the Internal Revenue Code, or non-taxable.”

Justices meet Friday to vote on health care case

“While the rest of us have to wait until June, the justices of the Supreme Court will know the likely outcome of the historic health care case by the time they go home this weekend.

After months of anticipation, thousands of pages of briefs and more than six hours of arguments, the justices will vote on the fate of President Barack Obama’s health care overhaul in under an hour Friday morning. They will meet in a wood-paneled conference room on the court’s main floor. No one else will be present.

Health Reform Law Ends Lifetime Limits For 105M Americans

Health and Human Services Secretary Kathleen Sebelius released a new report today on how the health reform law has eliminated lifetime limits on coverage for more than 105 million Americans. Before health reform, many Americans with serious illnesses such as cancer risked hitting the lifetime limit on the dollar amount their insurance companies would cover for their health care benefits.

A.M. Best: Health Insurers Adapting to a Changing Environment

“In 2011, health insurers faced numerous challenges related to the implementation of the Patient Protection and Affordable Care Act, new regulations and formidable economic conditions. Even with the emergence of these requirements and environmental difficulties, most carriers fared well and operating results remained strong due to a continued trend of low utilization. For 2012 and beyond, A.M. Best Co. expects margins may compress as health insurers are confronted with the full-year impact from the new rate-reasonableness requirement, and as utilization slowly rises.
